Virginia ABC seeks to fill a position for an Associate Legal Counsel. This position primarily assists the agency in the preparation and trying of cases before agency hearing officers, the Board, and Circuit Court as well as providing representation, guidance, and training to the agency Bureau of Law Enforcement in matters relating to enforcement, legislation, and hearings.

The Associate Counsel will resolve legal and policy issues; research, analyze, and provide issue resolution in the following areas: ABC licensing and regulatory issues, legislative initiatives, FOIA, and the Virginia Administrative Process Act.

This position will also represent the Bureau of Law Enforcement in appeals to the Board and may serve as an agency point of contact with the Attorney General's Office on Circuit Court appeals from Board decisions and to resolve legal issues and questions of law related to the agency's programs and processes. Other duties and responsibilities include but are not limited to:

  • Represent the interests of the Authority and the Bureau in connection with mediations, informal conferences, and initial hearings before an ABC hearing officer and appeals to the ABC Board under the Virginia Administrative Process Act.
  • Negotiate settlement of disciplinary cases at the agency level through the offer in compromise process.
  • Provides general legal guidance to the Bureau on law enforcement operations and matters, and serves as the Authority point of contact with the OAG.
  • Provide legal guidance and representation to the various divisions of the agency and will also represent the agency in Circuit Court.
  • Provide technical support and guidance in the development of policy, legislation, and regulatory proposals for the agency.
  • Reviewing and interpreting regulations and statutes applicable to ABC operations and programs to ensure agency policies are uniform and internal guidelines are in compliance with the law.
  • Help to design and provide legal training and law updates for BLE, the agency, leadership and personnel related to investigative, regulatory, and procedural matters as well as other areas of the law.


Minimum Qualifications

  • Juris Doctor Degree from an accredited law school is required.
  • Be an active member in good standing of the Virginia State Bar or possess the ability to waive into membership with the Virginia State Bar through reciprocity as a member of a state bar.
  • Willing to travel throughout the Commonwealth for case representation.

Preferred Qualifications:

  • Significant experience with trying cases before a judicial officer or tribunal
  • Experience with conducting policy analysis and development
  • Experience as an in-house counsel for a mid to large size corporation or agency.
